1. Agreement to Terms

By using Touch Maple's logistics and shipping services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided

Touch Maple provides freight forwarding, logistics management, warehousing, and related transportation services. Services are subject to availability and our acceptance of your booking request.

3. Booking and Payment

  • All bookings are subject to acceptance by Touch Maple
  • Quotes are valid for 30 days unless otherwise stated
  • Payment terms vary by service type and customer agreement
  • Late payments may incur additional charges
  • We reserve the right to hold shipments pending payment clearance

4. Shipping Documents

Shippers are responsible for providing accurate and complete shipping documentation including commercial invoices, packing lists, customs declarations, and any required permits or licenses. Inaccurate documentation may result in delays, additional charges, or refusal of shipment.

5. Transit Times and Delays

Transit times are estimates and not guaranteed. Touch Maple is not liable for delays caused by weather, customs clearance, government actions, carrier schedules, or other circumstances beyond our reasonable control. We will make reasonable efforts to notify customers of known delays.

6. Liability and Insurance

  • Basic carrier liability limits apply as per applicable international conventions (Warsaw Convention, Montreal Convention for air; Hague-Visby Rules for ocean)
  • Additional cargo insurance is available and recommended for high-value shipments
  • Touch Maple's liability is limited to the actual value of the cargo or the declared value, whichever is lower
  • We are not liable for indirect, consequential, or special damages
  • All claims must be reported within 7 days of delivery (or scheduled delivery date)

7. Prohibited Items

The following items are prohibited from shipment: illegal goods, hazardous materials without proper documentation, perishable items without special arrangements, cash, securities, and items restricted by applicable laws. Touch Maple reserves the right to refuse any shipment that violates these restrictions.

8. Customs and Duties

Importers/exporters are responsible for all customs duties, taxes, and fees unless otherwise agreed. While we assist with customs clearance, final responsibility for compliance rests with the shipper/consignee. Customs valuations and classifications are subject to customs authority determination.

9. Claims and Disputes

  • Claims for loss or damage must be filed in writing within 7 days of delivery
  • Claims for non-delivery must be filed within 30 days of scheduled delivery date
  • Supporting documentation (photos, delivery receipts, invoices) must be provided
  • Disputes will be resolved through good faith negotiation
  • Any legal disputes shall be subject to the jurisdiction of Ghana courts

10. Force Majeure

Touch Maple is not liable for failure to perform due to circumstances beyond reasonable control including natural disasters, war, terrorism, government actions, labor disputes, pandemics, or carrier unavailability.

11. Limitation of Liability

To the maximum extent permitted by law, Touch Maple's total liability for any claim shall not exceed the value of the specific shipment in question or the amount of insurance coverage purchased, whichever is lower.

12. Modification of Terms

Touch Maple reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of modified terms. Material changes will be communicated to active customers.

13. Governing Law

These terms are governed by the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of Ghana courts.
